NEW JERSEY RESIDENTIAL COMMUNITY HOME SEXUAL ABUSE LAWSUITS
Fighting for Survivors Sexually Abused at Residential Community Homes New Jersey
Levy Konigsberg is investigating claims that children were allegedly sexually abused at Residential Community Homes across New Jersey.
Residential Community Homes (RCHs) in New Jersey are state-operated or state-supervised facilities under the Juvenile Justice Commission that house minors placed through the juvenile justice and family court systems. These programs serve youth with behavioral, social, or substance-related needs and operate in structured, staff-secured environments where residents live, attend school, and participate in counseling and rehabilitative services under continuous supervision.
Accounts have been brought forward involving sexual abuse and misconduct in residential care settings, including improper contact by staff, coercion, and inadequate oversight of residents. These matters also call into question whether complaints were investigated and whether required safety protocols were followed.
Information has surfaced indicating sexual abuse and misconduct in these residential placements, with concerns that incidents were not isolated and that warning signs may have been overlooked over time.

History of Child Sexual Abuse in Residential Community Homes in New Jersey
Various investigations, lawsuits, and significant settlements have documented sexual abuse involving minors in New Jersey Residential Community Homes and juvenile facilities.
Examples of alleged abuse, and of conditions likely to lead to abuse, include the following:
D.O.V.E.S. RCH
Developing Opportunities and Values through Education and Substance Abuse Treatment (D.O.V.E.S.) is a Residential Community Home located in Hopewell, New Jersey. The program serves adjudicated juvenile females placed through the New Jersey Juvenile Justice Commission, including individuals with behavioral and substance abuse histories. As the state’s primary community-based residential program for this population, D.O.V.E.S. operates within a controlled setting where residents live under structured supervision and participate in counseling, education, and rehabilitative services.
Vineland Preparatory Academy
Vineland Preparatory Academy is a Residential Community Home (RCH) located in Vineland, New Jersey, and operates under the New Jersey Juvenile Justice Commission. The facility houses adjudicated juvenile males placed through the Family Court system, where they live in a controlled residential environment with structured supervision, education, and rehabilitative programming.
Southern RCH & Transitional Program
Southern RCH & Transitional Program is a Juvenile Justice Commission residential facility located in Egg Harbor City, New Jersey. The program serves adjudicated youth placed in a structured, step-down residential setting as they transition from secure custody toward community reintegration. With a limited number of beds and a defined program duration, residents remain under continuous supervision while participating in education, behavioral treatment, and reentry-focused services.
Warren RCH
Warren Residential Community Home (RCH) is a Juvenile Justice Commission facility established in 1960. The program houses male residents over the age of 16 who are placed through the state’s classification process, including individuals with substance abuse-related needs. As a staff-secured residential setting, residents remain under constant supervision while participating in structured programming, counseling, education, and vocational training.
Albert Elias RCH
Albert Elias Residential Community Home is a Juvenile Justice Commission facility located on the Johnstone Campus in Bordentown, New Jersey. The program serves male juveniles, typically ages 17 and older, who are placed in a structured residential setting focused on work readiness, life skills development, and community reintegration. Residents participate in vocational placements, including work-based programs with state agencies, while receiving counseling, educational support, and individualized case planning under staff supervision.
- In June 2024, Levy Konigsberg filed a lawsuit against the State of New Jersey on behalf of eight brave survivors of childhood sexual abuse perpetrated by staff members at the Juvenile Medium Security Facility (“JMSF”), the Juvenile Female Secure Care and Intake Facility (“Bordentown”), and Albert Elias Residential Community Home (“Albert Elias”) at the Johnstone Campus in Bordentown, NJ, as well as at Costello Prep Residential Community Home (“Costello”) in Tabernacle, NJ.
According to the lawsuit, the state allegedly turned a blind eye to a long-standing culture of misconduct perpetrated by staff members against youths.
Youths at the facility allegedly suffered abuse committed by staff members, from inappropriate strip searches, sexual assaults, grooming, and sexual abuse.
Levy Konigsberg Partner Moshe Maimon stated that vulnerable children in the custody of New Jersey suffered unthinkable abuse as victims of a broken juvenile justice system and that the state failed to uphold its responsibility to these children.
Green RCH
Green Residential Community Home is a Juvenile Justice Commission facility located on the grounds of Ringwood State Park in Passaic County, New Jersey. The program serves younger male juveniles, generally between the ages of 13 and 18, who are placed in a structured residential setting with continuous staff supervision. Residents participate in behavioral treatment programs, counseling services, education, and community-based work assignments as part of their placement.

Who Can You Sue in a Sex Abuse Civil Case?
In a sex abuse civil case, the parties you might sue can vary depending on the circumstances of the abuse and the relationships involved.
Some potential parties that could be sued in a sex abuse civil case include:
- Individual Perpetrator: The alleged perpetrator of the sexual abuse can be named as a defendant in the lawsuit. This is often the person who directly committed the abusive acts.
- Institutions and Organizations: If the abuse occurred within an institution or organization, such as a school, church, sports club, or workplace, and they failed to take appropriate action to prevent or address the abuse, they might also be held liable.
- Employers: If the perpetrator was an employee of an organization or institution, the employer might be held vicariously liable for the actions of their employee if the abuse occurred within the scope of their employment.
- Property Owners: If the abuse occurred on a property owned by someone else, and the property owner failed to provide adequate security or take reasonable steps to prevent the abuse, they might be considered liable.
- Government Entities: In some cases, government entities might be involved, especially if the abuse occurred within a state institution or facility. Suing a government entity might involve specific procedures and limitations.
Sex abuse cases can be legally complex, so it's highly advisable to consult with experienced legal professionals who specialize in this area to understand your options and pursue the appropriate legal action. Levy Konigsberg, along with our team of sexual abuse lawyers, is available to provide assistance for your sexual abuse case.
Do I Have a Case?
You may have grounds to file a civil legal action if:
- You were sexually abused by a guard, counselor, nurse, or other youth residential treatment or juvenile detention center staff member.
- The abuse occurred at any youth residential treatment or juvenile detention facility.
Levy Konigsberg represents survivors in civil lawsuits that aim to hold youth residential treatment facilities, juvenile detention centers, private healthcare companies, and other facility operators accountable for their failures to stop abusive staff members and protect young residents.
As civil claims, these cases are separate from any criminal proceedings that may arise from abuse and focus instead on holding institutions liable for damages. This means you may still have a claim even if:
- Your abuser is no longer alive.
- Your abuser was never charged with or convicted of a crime.
Recoverable Damages in Sexual Abuse Claims
In addition to providing accountability and a sense of justice, civil sex abuse lawsuits allow survivors to recover financial compensation for their damages, which may include:
- Past medical and mental health expenses
- Future mental health expenses, including therapy, medications, etc.
- Pain and suffering
- Emotional anguish and psychological harm
- Lost income
- Other economic and non-economic damages
New Jersey Sexual Abuse Attorneys
In New Jersey, the statute of limitations previously imposed a strict deadline for victims of sexual abuse to file claims or seek compensation. However, recognizing the lasting impact of sexual abuse and the obstacles survivors face in pursuing justice, the state enacted the Child Victims Act in 2019. This landmark legislation significantly extended the statute of limitations for civil sexual abuse cases. The law provides more opportunities for victims to seek justice and compensation, acknowledging the complexities and challenges associated with reporting and prosecuting sexual abuse.
Under New Jersey law, specifically NJ Stat. § 2A:14-2a, survivors of sexual abuse now have an extended timeframe to pursue legal action. Childhood sexual abuse victims can file civil claims until age 55 or seven years after recognizing the trauma, whichever is later. This allows survivors to seek justice against their abusers and any liable institutions. For those sexually abused as adults (age 18 or older), the deadline to file a civil lawsuit is seven years from the incident of abuse.
Seeking legal guidance is crucial when navigating the complexities of the statute of limitations. Your attorney can review your case, explain the statute of limitations to you, and assist you in determining if you are eligible to file a lawsuit.
