Accusations Against Dr. Ricardo Cruciani

Ricardo Cruciani was a neurologist with an advanced specialization in pain syndromes that were rarely understood by similar practitioners. This high level of comprehension and expertise made him the only available doctor to treat many patients who could not get help anywhere else. He uses this heightened position of power and authority to sexually harass, exploit, and abuse an unknown number of patients. Most of his victims have reported that they felt they had no choice but to let him sexually abuse them so that he would continue to treat them.

It is believed that Ricardo Cruciani—who is no longer technically a doctor after surrendering his medical license in 2017 when allegations against him first surfaced—has sexually abused his patients for at least 15 years. Most of his patients were aged between 30 and 55, the ages when neurological and pain disorders can become more apparent.

Penalties Used Against Ricardo Cruciani

After surrendering his medical license, Ricardo Cruciani was charged with 35 felony counts in Pennsylvania, including rape and aggravated sexual abuse. In 2022, a New York City jury found Dr. Ricardo Cruciani, 68, guilty of one count predatory sexual assault, one count of sexual abuse, one count attempted rape, two counts of rape and seven counts of criminal sexual act in connection to six patients who sought medical expertise to treat chronic and debilitating pain disorders. Cruciani will be sentenced for these crimes on September 14, 2022. Ricardo Cruciani has not yet been penalized civilly, though. Thanks to the Adult Survivors Act, civil action can soon be taken against him.

Important notes about the Adult Survivors Act of New York:

  • Lookback window: It creates a lookback window that begins on November 24th, 2022, and closes on November 24th, 2023. During this time, sexual abuse victims can bring civil claims against Dr. Ricardo Cruciani.
  • Removed statute of limitations: The lookback window allows individuals to sue abusers, as well as employers or institutions associated with the abuser, even if the statute of limitations on those claims have previously expired. For example, if you were sexually abused by Dr. Cruciani as far back as 2008, well beyond the former statute of limitations in New York for such cases, you will have a renewed opportunity to file a claim anyway within the lookback window.

Money can’t undo his terrible acts but pursuing civil action can help you find closure and a sense of justice. You deserve every chance you can get to try to put the aftermath of his abuse behind you. Let Levy Konigsberg stand up for you.

Cruciani’s Employers Might Be Liable Too. Let Us Be Your Voice—Call Now.

Many civil sex abuse lawsuits filed against Dr. Ricardo Cruciani have also targeted his former employers as defendants. It has been alleged that physicians and medical institutions knew that Cruciani was sexually abusing his patients. Yet no action was taken to investigate the situation and prevent further harm. If these allegations are proven true, then Dr. Cruciani’s former employers could be directly liable for many instances of his sexual abuse. We can determine who should be named as defendants in your sexual abuse lawsuit against Cruciani, so you don’t need to worry about these details yourself.

We know it is difficult to speak up against a sexual abuser, especially someone who had authority over you like Dr. Ricardo Cruciani. Who Can You Sue in a Sex Abuse Civil Case?

In a sex abuse civil case, the parties you might sue can vary depending on the circumstances of the abuse and the relationships involved.

Some potential parties that could be sued in a sex abuse civil case include:

  • Individual Perpetrator: The alleged perpetrator of the sexual abuse can be named as a defendant in the lawsuit. This is often the person who directly committed the abusive acts.
  • Institutions and Organizations: If the abuse occurred within an institution or organization, such as a school, church, sports club, or workplace, and they failed to take appropriate action to prevent or address the abuse, they might also be held liable.
  • Employers: If the perpetrator was an employee of an organization or institution, the employer might be held vicariously liable for the actions of their employee if the abuse occurred within the scope of their employment.
  • Property Owners: If the abuse occurred on a property owned by someone else, and the property owner failed to provide adequate security or take reasonable steps to prevent the abuse, they might be considered liable.
  • Government Entities: In some cases, government entities might be involved, especially if the abuse occurred within a state institution or facility. Suing a government entity might involve specific procedures and limitations.

Sex abuse cases can be legally complex, so it's highly advisable to consult with experienced legal professionals who specialize in this area to understand your options and pursue the appropriate legal action. Levy Konigsberg, along with our team of sexual abuse lawyers, is available to provide assistance for your sexual abuse case.

Do I Have a Case?

You may have grounds to file a civil legal action if:

  • You were sexually abused by a doctor or medical staff.
  • The abuse occurred at any medical facility.
  • You were sexually exploited or abused by someone in a position of power within an organization meant to provide support and care.

Levy Konigsberg represents survivors in civil lawsuits that aim to hold medical facilities and other facility operators accountable for their failures to stop abusive staff members and protect patients.

As civil claims, these cases are separate from any criminal proceedings that may arise from abuse and focus instead on holding institutions liable for damages. This means you may still have a claim even if:

  • Your abuser is no longer alive.
  • Your abuser was never charged with or convicted of a crime.

Recoverable Damages in Sexual Abuse Claims

In addition to providing accountability and a sense of justice, civil sex abuse lawsuits allow survivors to recover financial compensation for their damages, which may include:

  • Past medical and mental health expenses
  • Future mental health expenses, including therapy, medications, etc.
  • Pain and suffering
  • Emotional anguish and psychological harm
  • Lost income
  • Other economic and non-economic damages

Statute of Limitations for Civil Sexual Abuse Lawsuits

Dr. Cruciani is accused of sexually abusing children in multiple states.  Since he practiced medicine in multiple states, including Pennsylvania, New York, and New Jersey, the statute of limitations that will apply depends on the state in which the sexual abuse occurred.  Many states have enacted laws which expand the time in which a person has to file a civil lawsuit for child sex abuse.
