  • In April 2026, a man filed a lawsuit against BetMGM, alleging that the company was negligent despite his formal request to be excluded from gambling for five years. The lawsuit alleges that the company exploited users, contributing to gambling addiction.

Pennsylvania

  • In May 2025, it was reported that a federal class action lawsuit was filed against DraftKings in the U.S. District Court for the Eastern District of Pennsylvania, alleging that the company utilized exploitative marketing tactics targeting individuals struggling with gambling addiction. 

The complaint alleged that the company used customer data to target those prone to excessive gambling. 

One plaintiff alleged that the company allowed them to continue using the platform despite joining the state self-exclusion program.

  • In March 2026, a lawsuit was filed in a Pennsylvania state court against FanDuel and DraftKings, alleging they used NFL’s live customer data to develop addictive products. 

They allegedly used VIP hosts and in-game micro-betting, leading to severe gambling addiction.

The lawsuit alleged the company was allegedly aware of the gambling addiction problems but prioritized profits over user welfare. 

In March 2025, one of the plaintiffs was diagnosed with gambling addiction disorder and placed himself on the state’s self-exclusion list, yet a host allegedly continued to contact him.

New Jersey

  • In July 2025, an individual in New Jersey settled a lawsuit with DraftKings following allegations that the company facilitated gambling addiction, prioritizing profits over user welfare.

The company allegedly acted negligently in failing to identify signs of gambling addiction and neglected the mandatory verification of fund sources required by anti-money laundering regulations.
