EzriCare & Delsam Eye Drops Linked to Fatal Bacterial Infection
EzriCare Artificial Tears and Delsam Pharma Artificial Tears are over-the-counter eye drops manufactured by Global Pharma Healthcare. They were sold nationwide in multidose bottles in brick-and-mortar and online stores such as Walmart and Amazon.
While the eye drops are intended to be sterile, consumer complaints and investigations conducted by federal regulators have revealed that they were contaminated with a rare, extensively drug-resistant strain of Pseudomonas aeruginosa bacteria – specifically, Verona Integron-mediated Metallo-β-lactamase (VIM)- and Guiana-Extended Spectrum-β-Lactamase (GES).
Given the rising number of injuries, hospitalizations, and deaths, and at the request of the FDA, Global Pharma Healthcare issued a voluntary recall for three affected products in February 2023. This includes:
- EzriCare Artificial Tears
- Delsam Pharma Artificial Tears
- Delsam Pharma Artificial Eye Ointment
EzriCare & Delsam Eye Drops Linked to Fatal Bacterial Infection
The P. aeruginosa linked to EzriCare and Delsam Pharma eye drops is a rare strain of bacteria that has not been previously identified in the U.S. According to the CDC, it is notoriously difficult to treat, capable of rapidly self-replicating, and has been found to be extensively resistant to a range of antibiotics commonly used to treat severe infections.
Infections caused by EzriCare and Delsam Pharma Artificial Tears have been linked to:
- Keratitis (inflammation of the cornea)
- Endophthalmitis (infection of eye tissue or fluids)
- Respiratory or urinary tract infection
- Sepsis
- Hospitalization
- Vision loss / blindness
- Surgical eye removal
- Death
As of May 15, 2023, P aeruginosa infections linked to EzriCare and Delsam Pharma eye drops have been associated with a total of 81 infections in 18 states. Of these infections, 14 resulted in vision loss, 4 with surgical removal of the eyeball (enucleation), and 4 deaths.
EzriCare & Delsam Eye Drops Linked to Fatal Bacterial Infection
A growing number of victims across the country are now filing lawsuits against Global Pharma and other entities responsible for manufacturing, supplying, and marketing EzriCare and Delsam Pharma eye drops.
At the core of their lawsuits, victims allege that Global Pharma failed to meet its legal obligations to ensure that its products were safe to use as intended. To support these claims, many point to the FDA’s findings of Global Pharma’s current good manufacturing practice (CGMP) violations, including:
- Lack of appropriate microbial testing
- Formulation issues (i.e. failing to use an adequate preservative)
- Lack of proper controls concerning tamper-evidence packaging
Additional investigations into Global Pharma and its liability remain ongoing. At Levy Konigsberg, we’re closely tracking updates from federal regulators and working with professional experts of our own to explore potential claims that can be brought against at-fault defendants.
We specialize in dangerous drug lawsuits against powerful pharmaceutical companies, including those responsible for the harm caused by Depo-Provera.

How Much is an EzriCare Eye Drops Lawsuit Worth?
Generally, victims in personal injury lawsuits are entitled to a financial recovery of their damages. This may include:
- Pain and suffering
- Lost income and future wages
- Past and future medical expenses
- Disability and lost quality of life
- Lost emotional and financial support
- Other economic and non-economic damages
Litigation over EzriCare and Delsam Pharma eye drops is still in its early stages, and investigations are ongoing. This, coupled with the fact that every case is different, can make it difficult for plaintiffs to assess the potential value of their claims. As such, the best way to gauge the types of damages you may be able to recover is to have your matter reviewed personally by an attorney.
Civil lawsuits are subject to a statute of limitations, which functions as a type of legal deadline. If the statute of limitations in your case expires, you will not be able to file a lawsuit or recover compensation for your damages.
For this reason, it is strongly recommended that anyone with a potential claim reach out to our firm as soon as possible. Timely action can ensure that you are able to file a claim within the appropriate timeframe, and that the necessary work can be done to build the strongest claim possible.
