NORTH DAKOTA: MESOTHELIOMA ATTORNEYS HELP ND ASBESTOS EXPOSURE VICTIMS

Bismarck, North Dakota – Mesothelioma Attorneys from the National Asbestos Litigation Firm of Levy Konigsberg LLP (“LK”) Are Continuing to Help North Dakota Mesothelioma Patients and Families Obtain Legal Compensation from Companies Who Manufactured, Sold or Used Asbestos-Containing Products

Every year, thousands of men and women across the country are diagnosed with mesothelioma, including many in North Dakota. Even more are diagnosed with lung cancer and asbestosis. All of these asbestos-related diseases could have been prevented if workers had been properly protected from exposure to asbestos. Mesothelioma attorneys at LK are experienced in investigating the industrial asbestos exposures suffered by individuals throughout North Dakota.

Mandan Oil Refinery

With construction beginning in 1952 and operations officially underway in 1954, the Mandan Oil Refinery has employed thousands of North Dakota citizens between the 1950s and 1990s. The Tesoro Mandan Refinery occupies approximately 960 acres of land near the Missouri River with major operations located throughout the land, including refining activities and the operation of an alkylation unit, cat cracker, ultra-former, hydrotreater, poly unit and isom unit. Numerous skilled tradespeople, including electricians, millwrights, boilermakers, turbine operators, furnace technicians, laborers, and various other trades, were required to operate dangerous, high-temperature equipment. For decades, individuals in North Dakota worked with and around asbestos-containing equipment at the Mandan Oil Refinery.

Mesothelioma attorneys at LK previously represented a lifelong employee of the Mandan Oil Refinery. Our client worked in several different areas of the oil refinery, regularly working with and around asbestos-containing products. During our representation, we completed a voluminous document review consisting of several decades worth of purchase invoices of the products regularly purchased and received by the Mandan Oil Refinery, including many of the asbestos-containing products that Mandan Oil Refinery employees would have been exposed to on a regular basis. Attorneys at LK are experienced in representing former employees of the Mandan Oil Refinery. If you or a loved one were exposed to asbestos at the Mandan Oil Refinery and have developed an asbestos-related disease, attorneys at LK are prepared to vigorously investigate all possible sources of your asbestos exposure.

Pipeline Construction

To support the Mandan Oil Refinery, Service Pipeline began construction of a pipeline in 1952 to transport product from Tioga to the refinery in Mandan. Employees, independent contractors and other experts spent hundreds of hours at these worksites in North Dakota planning, building and supervising the construction of the Tioga-Mandan pipeline. Many of the products used in the construction of the Tioga-Mandan pipeline contained asbestos. Individuals present at this massive project were potentially exposed to large amounts of airborne asbestos while completing their work. If you were employed at the Tioga-Mandan pipeline project and have developed an asbestos-related disease, attorneys at LK can assist you and your family in seeking financial compensation for your injuries.

North Dakota Farms & Ranches

North Dakota enjoys a rich agricultural history, with 39 million acres of farms and ranches spread throughout the state, comprising almost 90% of the state’s land. With an average farm size of 1,241 acres of land, North Dakota families grew the nation’s wheat, corn and sugar beets and raised a substantial amount of the nation’s cattle and calves. Mesothelioma attorneys at LK understand the backbreaking effort, dedication and skill necessary to maintain such large operations. If you or a loved one were diagnosed with an asbestos-related illness due to work on a farm or ranch, we will vigorously investigate all sources of your asbestos exposure. After decades of physical, financial and emotional investment into their agricultural ventures, farmers and ranchers in North Dakota deserve the strongest legal advocacy possible.

Agriculture Machinery

Much of the equipment used by farmers and ranchers required brakes, clutches and other automotive components, including gaskets, seals, flanges and manifolds. Farming equipment, including tractors, cultivators, seeders, layers, planters, spreaders, sorters, fertilizing equipment, balers, mowers, toppers, backhoes, loaders, cutters, traction engines, threshing machines hog oilers as well as trucks and cars, were routinely used on North Dakota farms. Many farmers personally maintained this equipment, regularly performing required maintenance, including brake and clutch replacements as well as removal and installation of gaskets and seals. Although manufacturers of automotive components were aware of the dangers associated with exposure to asbestos as far back as the 1930s and 1940s, much of this automotive equipment incorporated asbestos through to the 1990s. Farmers and other employees were regularly exposed to asbestos while maintaining equipment critical to their operations.

North Dakota Military Bases

North Dakota is a proud home to two major Air Force bases: Grand Forks Air Force Base, Emerado, ND (Est. 1955.) and Minot Air Force Base, Ward, ND (Est. 1956).

Between the 1950s and 1990s, thousands of military personnel and civilian employees were stationed at Air Force bases located in North Dakota. Many skilled military personnel and civilian employees, including mechanics, boilermakers, machinists and other trades, worked with and around asbestos-containing equipment. Mesothelioma attorneys at LK have represented numerous victims of mesothelioma who were exposed to asbestos while stationed at a military base. If you or a loved one were stationed or employed at one of these North Dakota military bases and have developed an asbestos-related disease, an attorney at LK will assist you in identifying all possible exposures of asbestos you may have suffered while on a military base.

North Dakota Power Plants

Spread throughout North Dakota, many powerhouses were constructed and operated for several decades, including coal-fired plants, generating units and hydroelectric plants. Between the 1930s and 1980s, thousands of individuals in North Dakota were exposed to asbestos at these power plants. Many of the manufacturers of the machinery and equipment installed and replaced at these North Dakota power plants were aware of the dangers associated with asbestos to exposure but did nothing to warn plant employees who worked with and around those products on a daily basis.

The generation of power in North Dakota required the use of large, high-temperature equipment. Boilers, furnaces, turbines, cooling towers and ovens were installed, maintained and repaired at these power plants. This equipment required large amounts of asbestos-containing products to properly function. Other products, including pumps, valves, motors, wire, cable, heaters, air conditioning units, gaskets, packing, chillers, and steam traps were necessary to allow the powerhouses to properly function. Individuals working at these North Dakota power plants were exposed to high levels of asbestos dust from their work with or around these products.

An experienced attorney at LK will investigate your asbestos exposure and employment history to determine the best location for filing your case. Many companies who manufactured and sold asbestos-containing products incorporated their businesses in Delaware and conducted substantial amounts of business in the state. Due to their corporate presence in Delaware, asbestos lawsuits may be filed in Wilmington, where Delaware’s asbestos docket is located. Our client who was exposed to asbestos at the Mandan Oil Refinery pursued his mesothelioma lawsuit in the Delaware courts. During your free consultation, an LK attorney will review all options available to successfully handling your asbestos lawsuit.

Individual Case Review

In North Dakota, and across the country, many people also developed mesothelioma from non-occupational asbestos exposures, such as shade tree automotive work, home renovations and other hobbies, or from “second-hand asbestos exposure,” which occurred when work clothes contaminated with asbestos were worn home. An experienced Levy Konigsberg attorney will assist your family in determining all possible sources of your exposure to asbestos dust.

A Long History of Success in Mesothelioma Cases

Countless lawyers who advertise themselves as mesothelioma attorneys have never actually handled an asbestos case before. In fact, they refer them out to real mesothelioma lawyers for a fee.

That is not how we operate.

We are true, experienced mesothelioma attorneys who personally work on each case from beginning to end. We are always happy to meet our clients, whether at our New York, New Jersey, California, Georgia, Washington, or Maryland offices, at a client’s home or hospital, or anywhere in the country.

Our legal team has succeeded by negotiating tirelessly with manufacturers of asbestos products and their insurance companies, no matter how influential or uncooperative they are. We are even often able to recover compensation from companies that have long been bankrupt.

Most defense lawyers are familiar with our solid reputation and credentials and know in advance that we will not settle for less than the best possible offer. They know that we build every mesothelioma and asbestos case as if it is going to trial, and we have taken hundreds of cases to juries when a fair settlement had not been offered.

The mesothelioma attorneys at Levy Konigsberg have also served as lead counsel in major state and federal mass consolidation cases designed to benefit many hundreds of people diagnosed with mesothelioma and other types of asbestos-related diseases.

We are proud of the work our lawyers do on behalf of our clients, often in groundbreaking cases against the toughest defendants. Our law firm has obtained landmark asbestos and mesothelioma jury verdicts for exposures to welding rods, cable, asbestos gaskets and packing, commercial talc, and industrial equipment, including the first-ever jury verdicts against welding rod, cable, and commercial talk manufacturers.

Our law firm is frequently referenced by the legal press for our association with the largest and landmark asbestos and mesothelioma verdicts in virtually every category, including various jurisdictions, types of asbestos products involved, and forms of asbestos exposure.

We have recovered hundreds of millions of dollars in compensation for victims of mesothelioma and asbestos cancers, and we are prepared to fight for you.

Providing Your Case with the Individual Attention It Deserves

Unfortunately, many law firms today use a generalized approach to handling cases of the same type, even those as complex as mesothelioma cases.

With a goal of cutting back on the time spent on each case, they use broad-brush practices and techniques to process cases as fast as they can, often risking the possibility of missing important details in a case and, thus, undermining the goal of negotiating the best possible compensation for their clients.

Contrary to such mentality, we treat every case as if it was our only one. We investigate each case with a team of lawyers, paralegals, and leading experts in the field, all while being in constant communication with the clients, to ensure that we have done everything we could to reach the full potential of each individual case.

In many courts, mesothelioma cases are treated urgently and given high priority. This is particularly true if the claimant is alive. In some jurisdictions, the entire case can be resolved within four to five months; in others, it can take longer.

Here, at Levy Konigsberg, our mesothelioma cancer attorneys do everything possible to avoid delays and move our clients’ cases as quickly as we can. We accomplish this in large part due to the coordinated work of our team members and the fact that every mesothelioma case goes through a strict control and supervision, including regular follow-ups and reviews by the lead lawyers.

Our mesothelioma attorneys update clients on a regular basis, so that they always know of every important development on their case and that it is being taken care of. Our lawyers and support staff take every phone call with a high level of priority and try to answer them on the spot.

If unavailable at that very moment, we call clients back as promptly as possible. It is not uncommon that our mesothelioma attorneys provide clients with their personal cell phone numbers to address any urgent questions that the clients may have in the future.

Cases of Asbestos Exposure

Mesothelioma News

ATTENTION: Mesothelioma has no known cure and often causes severe pain, suffering, and other types of damage, such as loss of consortium, and loss of income. Additionally, due to the exceedingly high cost of mesothelioma treatments, many families exhaust savings and accumulate financial debt in order to pay for the medical expenses of their family member.

Under the law of most states, pain and suffering from mesothelioma may be compensated through the award of money damages, usually obtained with the help of experienced mesothelioma attorneys. In some states other types of damages may also be recovered.

Asbestos litigation affords mesothelioma victims the opportunity to receive financial compensation and hold accountable the companies that caused their asbestos exposure.

IMPORTANT: If you or your family member has been diagnosed with mesothelioma, you should get in touch with a mesothelioma lawyer as early as possible to determine if you have a mesothelioma case and to:

  • Preserve your rights to bring a legal action against the responsible parties within the limited time frame allowed by law, known as statute of limitations;
  • Obtain maximum compensation in your case by being able to:
    • Preserve evidence and establish facts of the asbestos exposure while the claimant is still alive and able to provide information;
    • File and resolve a lawsuit against the responsible parties before they file for bankruptcy or, if they already have, to obtain compensation before their bankruptcy trust funds run out of money;
  • Expedite your case, as courts tend to give higher priority to mesothelioma lawsuits where the claimant is still alive.

NOTE: We have offices located in New York, New Jersey, California, Georgia, Washington, and Maryland. Many of our mesothelioma lawyers are licensed to practice law in a number of U.S. states and have the capability and extensive experience of representing mesothelioma clients throughout the United States.
